The Finance Ministry is expected to provide clarification soon regarding whether the amendment to GST rules for online gaming, casinos, and horse racing will be applied retrospectively or prospectively, according to reliable sources.
Despite Finance Minister Nirmala Sitharaman's recent statement in parliament indicating prospective application, experts emphasize the need for more clarity as companies are receiving tax demand notices for previous years based on the recent amendment.

In its 50th meeting on July 11, 2023, the GST Council recommended a 28% GST on the entire face value of bets in online gaming, casinos, and horse racing.
Before this, there was uncertainty regarding the GST rate and valuation method, leading gaming companies to pay 18 percent GST on gross gaming revenue instead of 28 percent on the full betting amount. With the recent amendments, the GST department is issuing tax notices for previous years.
The reports further emphasize the critical need for clarification on GST applicability in the online gaming sector, especially after the GST Council's decision in July 2023. The importance of uniform tax regulations for fair competition suggests that the retrospective application of this tax regime could impact India's reputation and foreign investments. Clarity in tax directives is crucial for the industry's economic health and India's global standing.
