Supreme Court Rules: No Account Freezing After 10% GST Pre-Deposit
The Supreme Court of India has ruled that once a taxpayer pays the 10% pre-deposit required to file a GST appeal, the government cannot freeze bank accounts or recover additional funds. This landmark decision protects honest taxpayers and ensures fair enforcement under GST law.
The Supreme Court of India has given a major relief to taxpayers by ruling that once you pay the 10% pre-deposit to file a GST appeal, the government cannot freeze your bank account or recover more money.
This decision is a big win for businesses and individuals who follow the rules but still face pressure from tax officials.
What’s the Big News?
- No More Account Freezing: If you’ve paid the 10% pre-deposit (as per Section 107(6) of the CGST Act), the GST department cannot attach your bank account or take extra money.
- Automatic Stay on Recovery: Paying the pre-deposit means recovery actions are paused. You don’t need to ask for a separate stay.
- Protection for Honest Taxpayers: This ruling helps genuine taxpayers who were being unfairly targeted even after following the appeal process.
Real Case Example
In the case of Wingtech Mobile Communications India Pvt. Ltd., the company paid ₹24.46 crores (10% of a ₹244.63 crore demand) to file an appeal. But GST officials still froze their bank account and recovered ₹170 crores.
The Supreme Court supported the Andhra Pradesh High Court’s decision and ordered the refund of the extra amount taken.
Why This Matters
- Makes it easier to do business
- Strengthens taxpayer rights
- Promotes fair treatment under GST
