The government is exploring the option of permitting taxpayers to file updated or revised returns within the goods and services tax (GST) framework. This potential move aims to benefit taxpayers and minimize legal disputes related to indirect taxes.
The proposal suggests that taxpayers would have the ability to rectify various aspects of their returns, including tax calculations. Currently, there is no provision for filing revised returns under GST, except for minor corrections in invoice details on the portal. Industry stakeholders have been advocating for this feature, and there is an ongoing petition in the Supreme Court regarding the matter.
Unlike GST, the income tax system already allows for the filing of revised returns. Implementing this change in the GST framework is expected to simplify the return filing process, reduce litigation, and address unintentional errors made by taxpayers.
The Central Board of Indirect Taxes and Customs is currently finalizing the details, which will then be reviewed by the law committee of the GST Council and subsequently by the council itself. The envisioned facility is likely to be introduced initially for yearly returns and later expanded to quarterly ones. The entire process, from GST Council approval to implementation, is expected to take around 8-9 months, given the need for a substantial upgrade of the GST Network.

Addressing the need for revised returns, experts point out that many GST-registered entities often make natural human errors, such as miscalculations and counting inaccuracies. Providing an option for revised returns, along with pre-filled returns, can help correct such errors. However, they stress the importance of ensuring that the data is picked up in real-time, and validated, and businesses can edit all fields in the auto-populated returns. Additionally, tax payment computations should be based on the data populated by businesses.
