What is a Late Tax Return (Belated Return)?

A “Belated Return” simply means filing your tax return after the original due date. It is the government's way of giving you another chance to file.

The final deadline you cannot miss

If you missed the July 31st deadline, you still have time  but not unlimited time. The final date to file your late return is December 31st of the same year.

Example:
For income earned between April 2023 and March 2024:
Regular deadline: July 31, 2024
Final deadline to file late: December 31, 2024

If you miss December 31st, you normally cannot file your tax return for that year at all.

What it costs when you file late

Filing late is allowed, but it comes with a few costs.

1. Late filing fee

The fee depends on how much you earn:

2. Interest on unpaid tax

If you still owe tax, you will be charged 1% interest per month on the unpaid amount. This interest runs from August 1st until the day you file.

3. Loss carry-forward benefit may be lost

If you have business losses or capital losses (stock trading, business), normally you can carry these losses forward to offset future gains. If you file late, you may lose this benefit. Note: losses from house property (like home loan interest) have different rules and may still be carried forward.

How to file a late return  simple steps

  1. Go to the official Income Tax e-Filing website and log in.
  2. Click "File Income Tax Return".
  3. Choose the correct year for which you are filing.
  4. Select the usual ITR form you use (for example, ITR-1 or ITR-2).
  5. When asked for "Filing Type" or "Filing Section," choose: “139(4) – After due date”.
  6. The system will add the late fee (₹1,000 or ₹5,000). Pay the amount shown.
  7. Submit the return and e-Verify within 30 days.

Made a mistake in your late return?

You can still correct it. File a Revised Return to fix errors. But remember: you must revise before December 31st the final deadline for that year.
