The GST council has sent notices to many businesses regarding discrepancies in their claimed input tax credit (ITC). These notices follow an investigation into the ITC claimed by these firms, which revealed discrepancies between their annual returns.

According to Section 150 of the CGST Act of 2017, the notices were issued, requiring the assesses to provide a detailed explanation for the "underreported" input tax credits.

"Underreported" occurs when the input tax credit claimed in the annual return form (GSTR-9) is lower than the amount claimed in the monthly forms (GSTR-3B or GSTR 2B). GSTR-3B is a monthly self-declared summary of GST returns, while GSTR 2B is an auto-generated form listing eligible and ineligible ITCs for each month.

The majority of these notices were issued in January for the April to November period of 2023-24.

Businesses and experts argue that many notices are issued mechanically without verifying whether the assesses have genuinely used the ITC, increasing compliance requirements even though the law allows officials to request information returns.

"Several notices have instructed the assesses to reverse unclaimed ITC in GSTR-3B mechanically, without conducting any significant analysis," according to an expert who examined the reasons for reversing unclaimed ITC.

A GST notice is an official message sent by tax authorities to taxpayers regarding Goods and Services Tax (GST) matters. These notices can be issued for various reasons, such as:

- Informing or warning the taxpayer about any failure to comply with GST requirements, like late filing of returns or payment of taxes.

- Asking the taxpayer to provide additional information or clarification regarding their tax filings.

- Initiating penalty proceedings against the taxpayer for not following GST laws.

- Notifying the taxpayer about changes or updates in GST laws or procedures.
