This change goes back in time to July 1, 2017. In the past, there were many arguments about whether you could claim tax credit (ITC) on plant/machinery. Appeals / Penalties / Upfront Payment
  • The amount you need to pay upfront for appeals that are only about penalties is reduced to 10% of the penalty (under Section 107 for Appellate Authority and Section 112 for GSTAT).
  • A new penalty (Section 122B) is introduced for not following the "track & trace" rules: either ₹1,00,000 or 10% of the tax due, whichever is higher.
This makes it easier on your wallet for appeals only about penalties, but it also means there's a lot more at stake for following "track & trace" rules. For appeals, check if the new 10% rule helps you. For "track & trace," get your compliance plan ready and keep very good records.
SEZ / FTWZ / Warehousing / Schedule III A new rule (clause (aa) in paragraph 8 of Schedule III of CGST) states that supplying warehoused goods in SEZs/FTWZs before they are cleared for export or sold in the local market is not considered a "supply." There's also a limit on refunds for tax collected before this announcement. This changes how warehoused goods are treated for tax and refund purposes. Some past supplies might no longer be seen as "supply." Businesses in SEZs/FTWZs should review their warehousing transactions, refund claims, and how they handle tax. Update your contracts and standard operating procedures (SOPs).
