ITR Update: As we enter the last month of 2023, some taxpayers are yet to complete a crucial task before the new year begins filing their Income Tax Returns (ITR) for the financial year 2022-23.
It's important to note that the deadline for filing ITR is December 31st. Any filing after this date may incur both penalties and interest.
Section 234F of the Income Tax Act imposes a penalty of Rs 5,000 for late filing, but taxpayers with an income not exceeding Rs 5 lakh face a reduced penalty of Rs 1,000. If you have not filed your ITR yet, it's advisable to do so promptly.
In addition to the penalty, there is also an interest requirement: Late filing of Income Tax Returns (ITR) incurs a 1% interest charge on the unpaid tax amount under section 234A. Missing the deadline for filing ITR (by December 31) can have significant financial consequences, as both penalties and interest will be imposed on returns filed after this date.
However, taxpayers have the option to file ITR for this financial year at any time within the next 24 months (up to March 31, 2026), albeit with associated penalties and interest. It's important to note that filing an updated return to reclaim paid taxes is not allowed.
If a taxpayer misses even the initial due date for filing ITR, they won't be able to file the return for that financial year unless they receive a notice from the tax department.
In cases where urgent reasons hinder timely filing, taxpayers can request a condonation of delay under section 119. Additionally, they can seek an opportunity to file an ITR by explaining the reason for the delay to the department. In such instances, a fine of Rs 10,000 and a 1% interest charge will be imposed.
Failure to file ITR may also result in a case being filed under Section 276 CC of the Income Tax Act. Therefore, it is advisable to file the return before the last date to avoid various difficulties that may arise later.
