Tax Rules for Creators Earning from Facebook & Instagram Reels
The creator economy is booming, but taxes are unavoidable. This blog explains how income from Facebook and Instagram Reels is treated under Indian tax laws, covering ITR filing, deductions, TDS rules, and GST registration.
The creator economy is booming! Instagram and Facebook Reels are not just fun they’re also a source of income through monetization, brand deals, and bonus programs. But with money comes taxes, and that’s where things often get confusing.
If you’re earning from Meta platforms (Facebook/Instagram), here’s how the Indian Income Tax Department (ITD) looks at your income.
1. Nature of Income: Business or Profession
For tax purposes, the money you earn as a content creator or influencer is treated as “Profits and Gains of Business or Profession (PGBP)”.
It’s not considered salary, capital gains, or “income from other sources.” Why? Because you’re consistently creating content, signing contracts, and working with the clear goal of earning revenue just like any other business.
2. Filing Your Income Tax Return (ITR)
Since your income falls under PGBP, you’ll usually file either ITR-3 or ITR-4.
Option A: ITR-3 (Regular Business/Professional Income)
- Use this if your annual receipts are more than ₹50 lakh.
- Or if you want to claim all your actual expenses.
- You’ll need to maintain detailed books of accounts.
Option B: ITR-4 (Presumptive Taxation Scheme)
- Available if your receipts are up to ₹2 crore.
- You can declare at least 50% of your receipts as taxable income.
- No need to maintain detailed books—this is a big relief for small creators.
3. Claiming Deductions: Your Big Advantage
The best part of reporting income under PGBP is that you can deduct expenses related to your work.
Examples of deductible expenses:
- Equipment: Camera, phone, lighting, microphone, computer (depreciation applies).
- Internet & Software: High-speed internet bills, editing tools like Adobe Premiere or Canva Pro.
- Studio & Office: Rent for a shooting space or part of your home rent (pro-rata).
- Travel & Logistics: Costs for shoots, events, or location visits.
- Props & Goods: Costumes, makeup, or products used in videos.
4. TDS Compliance: Section 194R
This is a new and important rule. Under Section 194R, if a brand gives you free products or perks, they must deduct 10% TDS before handing them over.
Example: If a brand sends you a free phone worth more than ₹20,000 in a year, they’ll deduct 10% TDS on its value.
5. GST Registration
Apart from income tax, GST also applies.
- You must register for GST if your annual turnover from Reels, brand deals, and other services is more than:
- ₹20 lakh (most states)
- ₹10 lakh (special category states)
Once registered, you’ll need to charge GST on invoices and file regular GST returns.
ApnoKaCA’s Takeaway
- Maintain Records: Keep expense logs, bank statements, and invoices.
- Claim Depreciation: Reduce taxable income by accounting for gear depreciation.
- Consult a CA: Professional help is key to choosing between ITR-3 and ITR-4, and managing GST.
